This ordinance clarifies various building code provisions relating to connection of buildings and structures to sewers, and discharge of drainage from downspouts where sewers are not available.
BODY:
The Mayor and Common Council of the City of Milwaukee do ordain as follows:

Part 1. Section 225-4-2-a and b of the code is amended to read:

225-4. Drainage of Yard Areas and Roofs.

2. ROOF RAINWATER LEADERS (CONDUCTORS). a. All roof rainwater leaders on all buildings and structures except [[private]] >>residential detached garages and<< detached accessory buildings, not more than 1000 square feet in area, shall be mechanically connected to the storm sewer, combined sewer or to an approved storm sewer facility when they are available and abutting the property. >>This shall include parcels that have access by easement or private roads when the storm sewer is available at the point of access.<<

b. When a storm sewer or combined sewer is not available, the roof rainwater leaders, conductors or downspouts shall discharge to grade a minimum of 2 feet away from a basement foundation wall. The drainage shall be contained on the owner's property. The discharge water shall not create a nuisance on >>adjacent properties, or<< a street, alley or other public way.

Part 2. Section 225-22-2-b of the code is amended to read:

225-22. Municipal Service.

2.b. A building shall be deemed to have the facility available if the premises on which the building is located has been determined by the commissioner of public works to be served by the respective facility [[,and the building is located within 200 feet of the street line or recorded easement line being...
