This resolution authorizes cancellation of $3,769.75 of the City of Milwaukee's subrogation claim against Edelmira Wigen, for payments made pursuant to the City's Basic Health Plan. _____________________________________________
BODY:
Whereas, Edelmira Wigen has commenced a lawsuit against Esthel Azcueta, M.D., alleging a medical malpractice claim; and
Whereas, As a result of injuries allegedly sustained as a result of that medical malpractice, the City of Milwaukee has made payments on behalf of Edelmira Wigen for treatment of such injuries pursuant to its Basic Health Plan in the amount of $10,193.69; and
Whereas, The City of Milwaukee has a subrogation claim against Edelmira Wigen as a result of such payments; and
Whereas, The parties have agreed to settle this claim for $6,423.94, and the difference between the original claim and the settlement is $3,769.75; and
Whereas, This settlement reflects the legal liability of the parties and is a fair and equitable resolution of the City of Milwaukee's subrogation claim; now therefore be it
Resolved, By the Common Council of the City of Milwaukee, that the subrogation claim of the City of Milwaukee against Edelmira Wigen arising out of payments for treatment of injuries allegedly sustained as a result of her medical malpractice claim filed against Dr. Esther Azcueta in Milwaukee County Circuit Court, Case No. 96-CV-007807, is hereby cancelled in the amount of $3,769.75.
