Analysis
This resolution cancels a portion of the judgment entered on behalf of the City of Milwaukee and against Emilio and Ampara Jimenez by the Kohn Law Firm.
BODY:
Whereas, The Kohn Law Firm entered a judgment on behalf of the City of Milwaukee and against Emilio and Ampara Jimenez on March 18, 2002 in the amount of $56,760.19, Milwaukee Circuit Court Case No. 01-CV-012-316, for real estate taxes through 2000 at 1438 South 6th Street, tax key no. 462-0232-000; and
 
Whereas, The Kohn Law Firm has determined that Emilio and Ampara Jimenez have no assets from which to pay the judgment and are subsisting on social security; and
 
Whereas, In 2004 the property was acquired by Agustin Ruiz, who intends to open his own business repairing and customizing vehicles at this property; and
 
Whereas, The maximum loan commitment Agustin Ruiz can receive from the bank for this purpose is $42,000, of which $9,698.76 will pay the 2001 through 2003 delinquent real estate taxes and $32,301.24 will settle in full and satisfy the judgment for earlier real estate taxes; and
 
Whereas, The settlement of the judgment is in the best interests of the City; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the judgment against Emilio and Ampara Jimenez be settled for $32,301.24 and that $24,458.95 of said judgment be and is hereby cancelled.
