Hallbrooks. The applicant said that this is technically his 3rd location in the business, that he started on 1st St. (same district) and moved to what was Walker’s Lounge for 3.5 years and had the license revoked due an incident that happened there. He added that this application has been on hold for more than a year and that he has been in communication with Ald. Perez in order to move forward. He also explained that he has a barber shop (9 yrs) where he handles an apprenticeship program in the same district. Individuals also present: Ald. Perez said that the applicant held a license on 5th St which resulted in a nonrenewal, that the applicant got a TRO, went to court, that the nonrenewal was upheld in court and that the business has been shot down for a year and half. He also said for the record, that this new location is in a busier street and that the applicant is going to put in place a set of security measures to avoid what happened at the previous place. He also mentioned that he told the applicant that there will be a new development on the street (100 units) that will have their eyes/ears on this location and the bar next door. He added that there is an issue with the distance between the front door and the street/curb and the way that they are going to regulate patrons coming in/out. Atty. Hallbrooks said that Ald. Perez has been very clear and helpful on the process. The applicant said that he is not going to be understaffed, that there will be about 8 security guards and that they will be watching each door. He added that there will be a female and male guard at the front door for searches and one guard controlling traffic to avoid what happened on 5th St. He also said that as people make their way in, there will be another guard checking ids, another one directing traffic and a floater walking through the night. The applicant explained that there will be a vacant parking lot available from 8pm to 3am with valet parking services offered by another company, that he must have insurance to use it as well as the parking lot from Mc Donald’s. The applicant said that 3 employees will be doing the valet service and another 3 will be monitoring the parking lots. Ald. Brostoff asked if the security guards will be armed. The applicant said that has not made a determination yet. Ald. Burgelis asked if he would have access to surveillance cameras on the parking lot. The applicant said that he will. Ald. Burgelis moved to amend the plan of operations to reflect that there will be surveillance cameras on the parking lots that will be leased. There were no objections. Ald. Perez said that the number of security guards must be according to capacity, that they must be all set since day one scanning ids and that the establishment should be properly staffed according to capacity to avoid the issues that happened at the previous location. There were no neighbors present to testify. Ald. Perez said that he has been crystal clear with the applicant, and that the applicant has spent significant time at the court, that he is thinks that he knows his responsibilities and that he is comfortable moving forward. Andrew Clausen and Mr. Michael Cohen (District Manager) appeared on behalf of the applicant. Mr. Cohen said that they have been working on addressing the issues from the police report. He said that there is a guard seven days a week from 1pm until close, that this store is 1out of 10 experimental strategies approved with plastic cases on cosmetics walls and personal hygiene (custom built) and that it is also under contract with ALTO services (the company keeps a log of shoplifters events and works with the DA office when it is time to prosecute) Individuals also present: Ald. Spiker recognized that it is a difficult situation with shoplifters. Ald. Perez asked when the store started with the security guard and if they are asked to redirect/move away the panhandlers because it is one of the complaints. Mr. Cohen said that since April or March and that panhandlers are asked to move away. Ald. Perez said that Walgreens is doing efforts to take care of the problem. Mr. Cohen said that there has been some challenges with security but that they are doing better, that they are asked not to be physically engaged unless there is physical/safety treat. Ald. Perez asked about the issues with the trash. Mr. Cohen said that they have staff monitoring the premises and parking lot once/day at minimum and that there is a contractor that checks and clean the premises and perimeter twice/week as well. Ald. Westmoreland moved to amend the plan of operations to reflect the clean up once/day through the parking lot and perimeter. Ald. Perez said that the business is cooperative and that it is good for the community to hear the efforts of the company on a challenging area. He added that those panhandlers jump from one business to the other and that he hopes that they can share experience and resources among businesses. There were no neighbors present to testify. Ald. Perez said that he spoke to the applicant and the she must be responsible and know her licenses. The applicant agreed. Ald. Zamarripa said that item 5 on the police report says that her employees did not behave well with the police officers which is concerning. The applicant said that she talked to her employees and apologized for the insults on behalf of everybody. Ald. Zamarripa asked the applicant if going forward she is going to cooperate with MPD sharing surveillance videos and calling. The applicant agreed. Ald. Zamarripa said that she wants to make sure that she understands Ald. Perez’s point that she is responsible for her patrons inside and outside of the premises. The applicant said that she understands. Perez pointed out that the applicant is showing two licenses with different hours of operation and that he wants to know for the record the current hours. The licenses were handed to Mr. Cooney and said that the approved hours are Sun from 12pm to 2am, Mon-Thu from 6am to 11pm and Fri-Sat from 6am to 2:30am. The applicant said that the license without the public entertainment was the one she received first. She also mentioned that the second license is the one with the correct hours but that she did not know until she came here to request the new entertainment types and the tavern license was printed again with different hours. Ald. Zamarripa noted that the change of hours is only for Thursdays. The applicant said that she wants to do a Ladies’ night kind of thing. Ald. Perez said that he wants to make a comment regarding the changes and that he is ok with the change of hours on Thursdays. Ald. Westmoreland mentioned that the amusement machines and the pool table were there when the police came and asked if they were removed. The applicant said that she did not have a pool table and that the amusements machines have been unplugged since then. Ald. Spiker asked the applicant if he is planning to apply for an alcohol license later in case selling chicken and hamburgers is not enough. The applicant said that he can make it work without alcohol. Ald. Zamarripa asked about his experience in the industry. The applicant said that he has been working at Checker’s since he was 15 years old and that he has owned other type of businesses. Mr. Ellzey asked why the Power Hour Lounge never opened. The applicant said that his partner and girlfriend lived on the apartment upstairs and that they were conducting illegal gambling where a kid was shot. He added that he owns the building and that he would live it alone for few years to let it breathe. Ald. Zamarripa said that the file contains many objectors (they were called) who are not here present to testify. She added that only one objection is for the food application, that the rest are against the alcohol application, which was withdrew before. Mr. Ellzey said that they are not supporting the application because the business is not an existing operation and based on concentration. Ald. Spiker asked to take a look to the concentration map because there is no such saturation. Mr. Ellzey said that there is enough in the area for the neighbors to be satisfied with the options that they have. Ald. Burgelis asked that the concentration map be seen on the screen. Once the map was on the screen, he said that he does not see the concentration concern according to the map and asked if there is a different issue that has not been explained. Mr. Ellzey said that they are just developing a plan for healthy food options and to cut back on what there is a lot already. Ald. Burgelis said that he still disagrees with the concentration argument. Ald. Spiker asked the applicant if he could commit to have healthy and fresh foods, fruits and vegetables. Mr. Cooney said that they could do the amendment but that it is difficult to enforce. Ald. Westmoreland asked if it is going to be a grocery or convenience store. The applicant said that he will have a little of everything. Ald. Chambers said that circumstances happened under a previous application where the applicant was the owner and that he did not earn the community’s trust. He added that the applicant did not take ownership of what happened at his previous business project and that all that he says is that he was not responsible, that it was his partner’s, etc. Ald. Westmoreland said that he does not think that it is fair that the old application keeps coming in front of this one because there is nothing pending against him and when he is trying to do something different. He added that none of the objectors are present which makes him think that those objections are for the alcohol. Ald. Chambers said that the applicant was the partner, that he bought the building, etc. Atty. Travis advised the committee to talk only about the applicant’s management capabilities and to be cautious about what is being discussed at the table. Ald. Zamarripa asked Ald. Chambers what happened with the previous application. Ald. Chambers said that Mr. Adams purchased the building, reached out to neighbors to hear the concerns but that he was not getting the support that he needed in order to move forward. He added that there were videos about illegal activities that were happening inside the building. Ald. Spiker said that the applicant owns the building where the tragedy happened. He also said that what happened does not weigh in the same way when the intention is to serve hamburgers and to sell bananas. Ald. Stamper said that the corner looks horrible and that this establishment has been an issue over the years. He added that he has explained the applicant why a corner store does not work there. He requested that the license be denied as a resident and as the local alderman. Ald. Zamarripa asked Ald. Stamper if the applicant lacks the experience to run the establishment. Ald. Stamper answered “absolutely”. Ald. Zamarripa asked Ald. Stamper if he is concerned about the public safety. Ald. Stamper answered that he is. The applicant said that the building has been cleaned up, painted, etc. and that Ald. Stamper is talking about another store because this place is clean and no one is selling anything because it is closed. He also mentioned that he went to MPD and that there is no record for this address. He added that it is clean in every way and the he thinks that there is something after him. Ald. Pratt asked te applicant if he is going to have another manager. The applicant said that he is going to be there and that it is his first time at the front. He added that he is not perfect, that he has learned and that he wants to make the neighborhood better. He added that they keep an eye on each other and that they call the police if needed. He added that the store is safe. Ald.
