This resolution authorizes settlement of the lawsuit brought by Jack A. Schaefer and others. _______________________________________________________
BODY:
Whereas, The plaintiffs, Jack A. Schaefer and others have commenced a lawsuit against the City of Milwaukee Police Department and other officials of the City of Milwaukee, seeking an unspecified amount of damages; and
Whereas, The plaintiffs and the City of Milwaukee had previously agreed to settle this action in the form of a class action proceeding, with the payment of $75,000.00 in satisfaction of all claims of all of the members of that class; and
Whereas, The district court subsequently determined that it would not be appropriate to certify this matter as a class action; and
Whereas, The remaining four individual plaintiffs have agreed to settle their lawsuit on their own behalf for the payment of the amount of $7,500.00; and
Whereas, the City Attorney recommends and the Common Council of the City of Milwaukee deems it expeditious and just to settle this claim, now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the proper City officers be and hereby are authorized and directed to issue a City check in the amount of $7,500.00, payable to the trust account of Monogue & Witt, S.C., in full and final settlement of this lawsuit, upon receipt of a release of claims, approved as to form and execution by the City Attorney, said amount to be charged to the Damages and Claim Fund, Account No. 01-013-8001.
