Body
Whereas, Michael R. Garcia and Cynthia A. Garcia have submitted an Offer to Purchase the vacant, tax-deed lot at 11500 West Green Tree Road, Tax Key No. 113-9976-100-1, in the amount of $2,500 for construction of an owner-occupied single-family home; and
Whereas, Sewer and water laterals are not available to service this site; and
Whereas, The Department of City Development ("DCD") has determined that the purchase price is reasonable given the absence of building services and therefore recommends acceptance of said Offer contingent upon site and building plan approval, a financial commitment in place to complete the construction as proposed, and construction to be completed within 18 months from date of Offer acceptance; and
Whereas, DCD recommends sale in an "as is" condition without representations or warranties including but not limited to soil quality and subsurface condition; and
Whereas, The City Plan Commission has determined that said lot is surplus to municipal needs; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that said lot is declared surplus; and, be it
Further Resolved, That said Offer to Purchase is accepted and that the proper City officials are authorized and directed to perform such acts as necessary to carry out the intent of this resolution with the proceeds from the sale, less a 15 percent development fee to the Redevelopment Authority of the City of Milwaukee, be credited to the Reserve For Tax Deficit Fund Account No. 0001-334106.
