Analysis

This resolution authorizes payment of the claims of Chris, Christina, and Isabella Marshall in the amount of $115,000.

Body

Whereas, The claimants, Christopher, Christina, and Isabella Marshall, through their attorneys, Warshafsky, Rotter, Tarnoff & Bloch, S.C., have filed claims for damages against the City of Milwaukee for injuries and damages incurred on August 12, 2017 as a result of a police dog bite of Isabella Marshall; and

 

Whereas, The claimants have agreed to settle their claims in the total amount of $115,000; and

 

Whereas, The City Attorney recommends and the Common Council of the City of Milwaukee deems it expeditious and just to pay these claims; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee that the proper City officials be and are hereby authorized and directed to issue a City check in the amount of $85,000 payable to the order of Pacific Life & Annuity Services, Inc. and to issue a City check in the amount of $30,000 payable to the order of Warshafsky, Rotter, Tarnoff & Bloch, S.C. Trust Account in full and final settlement of said claims, on receipt of a Release of Claims, approved as to form and execution by the City Attorney, said amount to be charged to the Damages and Claims Fund, Account No. 636505,Fund No. 0001, Organization No. 1490, Program No. 2632, Sub Class No. S118.
