Title

Analysis
This resolution permits the City of Milwaukee to dedicate land for public right-of-way through execution and acceptance of a quit claim deed.
Body
Whereas, By adoption of File No. 100021, the Common Council authorized the Department of Public Works (“DPW”) to commence preliminary engineering for reconstruction of South 35th Street between West Burnham Street and West Greenfield Avenue to improve vehicular and pedestrian safety; and

Whereas, To facilitate the reconstruction, DPW requested that approximately 787 square feet of the Burnham Playfield at 1755 South 32nd Street be dedicated as public right-of-way; and

Whereas, The Burnham Playfield is under the jurisdiction of the Milwaukee Board of School Directors (“School Board”); and

Whereas, On August 25, 2011, the School Board authorized the dedication of the area as public right-of-way for no monetary consideration, since the improvements that will be made will improve student safety; and

Whereas, The legal description of the property to be dedicated through a quit claim deed to the City of Milwaukee is as follows:

That part of Lands in the Northeast 1/4 of Section 1, Township 6 North, Range 21 East, described as follows: Commencing at the intersection of the north line of West Burnham Street and the east line of South 35th Street; thence North 00°12’28” West, along said east line, 205.00 feet to a point; thence South 03°04’13” East, 100.12 feet to a point 5.00 feet east of, as measured normal to, said east line; thence South 00°12’28” East, parallel to said east line, 99.80 feet to a point; thence South 46°22’00” East 6.93 feet to a point on the north line of West Burnham Street, said point being 10.00 feet east of,...
