Resolution approving and authorizing the City Engineer to execute an easement agreement between the City of Milwaukee and Lighthouse Development Company, LLC to allow the existing City conduit system to remain in place in the vacated right turn bypass located on the south side of East Pittsburgh Avenue at South Water Street, in the 12th Aldermanic District.
Analysis
Lighthouse Development Company, LLC, 235 East Pittsburgh Avenue and 209 - 261 South Water Street, petitioned the City of Milwaukee to vacate the right turn bypass on the south side of East Pittsburgh Avenue at South Water Street. The partial street vacation was approved with the adoption of Common Council Resolution File Number 071176 on October 7, 2008. A communications manhole, conduit and cabling are now located within the vacation limits. As part of the vacation conditions, the property owner has agreed to grant an easement to the City to allow the existing conduit system to remain in place within the vacation limits to allow for future maintenance and operation of the facility. This resolution authorizes the City Engineer to execute an easement with Lighthouse Development Company, LLC.

Whereas, Lighthouse Development Company, LLC requested that the right turn bypass located on the south side of East Pittsburgh Avenue at South Water Street be vacated to support their site development; and

Whereas, Said right turn bypass was vacated with the adoption of Common Council Resolution File Number 071176 on October 7, 2008; and

Whereas, A condition of said vacation was that Lighthouse Development Company, LLC, 235 East Pittsburgh Avenue and 209 - 261 South Water Street, would grant an easement to the City to allow the existing communications manhole, conduit and cabling to remain in place and allow the City to maintain and operate said facility; and
