Resolution authorizing the Commissioner of Public Works to execute a project agreement and appropriating funds for these purposes for the “Cost Sharing Memo of Understanding Between the City of Milwaukee and Deer District LLC” for the cost sharing of sidewalk replacement on N. Vel R. Phillips Ave. in the 4th Aldermanic District with a City share of $125,000.
Body
Whereas, The sidewalk was constructed in 1988 and requires replacement; and

Whereas, This project is permitted as part of a Deer District development in 2025; and

Whereas, The City of Milwaukee has jurisdiction over the Right of Way adjacent to the development project limits and will share the construction costs for portions within the Right of Way; and

Whereas, Deer District will be the lead agency for construction; and

Whereas; Deer District has agreed to undertake the construction work with the City of Milwaukee paying for the portion within the City of Milwaukee jurisdiction for all construction expenses; and

Whereas; The City of Milwaukee and Deer District have agreed to the scope of work and retain all responsibilities to the right of way and property parcel; and

Whereas; Any cost overruns and/or changes in scope shall be approved by the Department of Public Works and the Deer District with costs divided based on property boundaries; and

Whereas, This project is programmed for construction in 2025; and

Whereas, The engineering cost was approved in Resolution File Number 250267; and therefore, be it
