Title
Substitute resolution relating to Disadvantaged Business Enterprise certification and re-certification refunds.
Analysis
This resolution directs the Department of Administration to refund all Disadvantaged Business Enterprise (DBE) certification fees paid to the City since it enacted a "sliding-scale" certification fee with Common Council File Number 000974 (enacted November 10, 2000). The amount refunded to each certified DBE will be less $50 for the new DBE certification and re-certification fee established by Common Council File Number 011505.

Whereas, The Common Council, on November 10, 2000, enacted Common Council File Number 000974 which, among its provisions, established a "sliding-scale" fee for businesses wishing to be certified as eligible for participation in the City's Disadvantaged Business Enterprise (DBE) program; and
Whereas, Under the terms of that ordinance, DBE's seeking a 3-year certification are assessed a fee equal to 0.2 percent of their gross sales or $2,400, whichever is less; and
Whereas, Common Council File Number 011505, an ordinance relating to a Disadvantaged Business Enterprise certification or re-certification fee, reduces the 3-year certification fee to a flat $50 per DBE certified; and
Whereas, The City now desires to refund the certification fees paid by DBE's since the enactment of Common Council File Number 000974, less $50; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Common Council authorizes and directs the appropriate officials within the Department of Administration to refund all certification fees paid pursuant to Common Council File Number 000974, less $50 for each certified DBE, and to pay for these refunds out of the special fund created within the 2002 Common Council Contingent Fund pursuant to Common Council File Number 011713.
