Analysis
This resolution will declare said tax deed lot surplus to municipal needs and will permit the City to accept an unsolicited Offer pursuant to Section 304-49-17, Milwaukee Code of Ordinances.
Body
Whereas, Ken J. Weber, Jr., has submitted an unsolicited Offer to Purchase the paved, tax-deed lot at 2617 South Lenox Street in the amount of $5,000; and

Whereas, Mr. Weber's business, The Brickyard Gym, is located at 2651 South Kinnickinnic Avenue and this parking lot will be utilized as off-street parking not only by his business and clients but Mr. Weber has offered its use to neighboring businesses located on South Kinnickinnic Avenue; and

Whereas, Mr. Weber will maintain the property at his expense; and

Whereas, Section 304-49-17, Milwaukee Code of Ordinances, allows the City to accept unsolicited Offers in special circumstances where the City receives fair market consideration; and

Whereas, Mr. Weber's Offer represents fair market value and direct sale to him is appropriate since he has agreed to let neighboring businesses use the parking lot; and

Whereas, The Department of City Development (“DCD”) recommends acceptance of Mr. Weber's unsolicited Offer to Purchase in the amount of $5,000; and

Whereas, Said lot is to be sold in an “as is” condition without representations or warranties including but not limited to soil quality and subsurface condition; and

Whereas, The City Plan Commission has determined that there is no municipal need for said parking lot; now, therefore, be it
