Substitute resolution appropriating Common Council Contingent Funds for the purpose of paying employer and employe annuity contributions due to the Policeman's Annuity & Benefit Fund for years 1989 through 1994.
ANLS:
This resolution responds to the request of the President of the Retirement Board of the Policeman's Annuity & Benefit Fund that the City remit contributions to the employer and employe contributions for spouse annuity due the Policeman's Annuity & Benefit Fund for the years 1989 through 1994 in accordance with applicable City Attorney opinions.
BODY:
Whereas, In opinions of the City Attorney dated September 5, 1995 and December 11, 1995, the City Attorney advised that the City was obligated to make employe contributions for widow's annuity of 4.125% of earnable compensation and employer contribution of 2.5% of earnable compensation for active members of the Policeman's Annuity & Benefit Fund; and

Whereas, In an opinion dated April 23, 1996, the City Attorney advised that there was an applicable statute of limitations of six years on contributions; and

Whereas, George Sprague, President of the Retirement Board of the Policeman's Annuity & Benefit Fund requested that the amounts due and owing under the City Attorney opinions be paid and in response thereto the City Comptroller has calculated the amount due and owing for the years 1989 through 1994; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee that the sum of $15,864.88, together with accrued interest at the rate of 4% be appropriated from the Common Council Contingent Fund to the Policeman's Annuity & Benefit Fund (Account Number 08-440-8200) for employe contributions and employer contributions for widow's annuity for the years 1989 through 1994; and, be it
