Analysis
This ordinance defines the terms “escort service” and “tattooing or body-piercing establishment” for zoning purposes. It also explicitly excludes “escort service” from the definition of “general office” and “tattooing or body-piercing establishment” from the definition of “personal service”.

In addition, this ordinance classifies escort services as special uses in the following zoning districts: the RO1/RO2 residential and office districts, all commercial districts, all downtown districts, all industrial districts and the institutional districts. It classifies tattooing or body-piercing establishments as special uses in the same zoning districts, with the exception of the C9H (Downtown-Warehousing and Light Manufacturing), IO1/IO2 (Industrial-Office), IL1/IL2 (Industrial-Light) and IH (Industrial-Heavy) districts, where these establishments would be prohibited uses.

This ordinance classifies both escort services and tattooing or body-piercing establishments as limited uses in the RS6 (Single-family Residential), RT4 (Two-family Residential) and RM3-RM7 (Multi-family Residential) zoning districts. The limited use standards are as follows:

1. The structure to be occupied was constructed prior to October 1, 2002.

2. The structure was originally designed and intended to be occupied in whole or in part by a non-residential use.

3. The structure has been continuously occupied by the non-residential use.
