Analysis
This resolution will result in the sale of a vacant, city-owned parcel of land for residential development.
Body
Whereas, Common Council File No. 010624, adopted September 25, 2001, declared the properties at 2437-53, 2455 and 2469-71 South St. Clair Street surplus and authorized the Department of City Development (“DCD”) to solicit proposals for new residential construction; and

Whereas, DCD advertised 2469-71 South St. Clair Street for residential development and three Offers were received; and

Whereas, Rick A. Macek submitted the highest bid of $70,150 to purchase the parcel for the purpose of constructing single-family housing for resale to owner-occupants; and

Whereas, Mr. Macek's Offer was contingent on the City installing sewer and water mains in St. Clair Street; and

Whereas, The two other bidders withdrew their bids upon learning that there were no sewer or water mains in St. Clair Street; and

Whereas, DCD has determined the land has no value without sewer and water mains; and

Whereas, DCD recommends that the full purchase price of $70,150 be utilized to pay a portion of the cost of installing the sewer and water mains; and

Whereas, DCD recommends acceptance of Mr. Macek's Offer contingent upon site and building plan approval prior to closing on said parcel; and

Whereas, Said parcel is to be sold in an “as is” condition without representations or warranties including but not limited to soil quality and subsurface condition; and

Whereas, The City Plan Commission has determined that there is no municipal need for said parcel; now, therefore, be it
