This resolution authorizes settlement of the lawsuit of Bernadette Enders v. City of Milwaukee, et al., in the amount of $53,823,63. _____________________________________________
BODY:
Whereas, The plaintiff, Bernadette Enders, has obtained a jury verdict against the defendants, Visu-Sewer Clean & Seal, Inc. and the City of Milwaukee, in the amount of $208,000.00; and
Whereas, The liability of the City is limited by statute to $50,000.00 plus statutory costs in the amount in this case of $3,823.63; and
Whereas, The City Attorney recommends and the Common Council of the City of Milwaukee deems it expeditious and just to pay the City's portion of the verdict as limited by statute and the related statutory costs; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the proper City officers be and hereby are authorized and directed to issue a City check in the amount of $53,823.63 payable to the order of Bernadette Enders and Blumenfeld, Rose & De Jong, her attorneys, in full and final settlement of the plaintiff's claims against the City of Milwaukee, upon receipt of a Satisfaction of Judgment, approved as to form and execution by the City Attorney, said amount to be charged to the Damages and Claims Fund, Account No. 01-149-0-6382-013-8001.
