TITLE

Resolution approving and accepting the Drainage and Access Easement Agreement between the City of Milwaukee and Wal-Mart Real Estate.

ANALYSIS

This resolution authorizes the proper City officers to execute a Drainage and Access Easement Agreement relating to a public alley south of West Main Street and west of South 70^th Street for the development of a Walmart grocery store.

BODY

Whereas, Wal-Mart Real Estate (Walmart) intends to develop the land south of West Main Street between South 70^th Street and South 72^nd Street as a Walmart grocery store; and

Whereas, Walmart intends to incorporate the existing public alley, just west of South 70^th Street, into their development plans; and

Whereas, Walmart will not restrict the public use of this alley in any way; and

Whereas, Walmart agrees to accept storm water from the public alley into their drainage system; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee that the proper City officers are authorized to execute a Drainage and Access Easement Agreement, incorporated in this resolution by reference as though set forth in full; and, be it

Further Resolved, That the proper City official is directed to submit the Drainage and Access Agreement to the Milwaukee County Register of Deeds for recording against the property described in the Agreement.
