Substitute resolution authorizing the execution of a water service agreement with the Village of Menomonee Falls.

This resolution authorizes the proper City officers to execute an agreement that will provide wholesale water service to the Village of Menomonee Falls.
BODY:
Whereas, The Common Council, under Resolution File No. 970228, authorized the negotiations between the City and the Village of Menomonee Falls for a wholesale water service agreement; and
Whereas, Such negotiations have resulted in an agreement attached to this file that is similar to other wholesale water service agreements the City has with other abutting communities, and which also includes provisions regulating resale and exchange of water purchased by the Village of Menomonee Falls from the City of Milwaukee; and
Whereas, The execution of this agreement will terminate the payment of $25,606 annually from the City of the Village, which payment would continue until the year 2020 if a water service agreement is not executed; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the proper City officers are authorized and directed to execute the wholesale water service agreement attached to this file that provides water service to the Village of Menomonee Falls, with paragraph (c) on page 5 amended to read as follows:
"(c) No water purchased by Menomonee Falls under this agreement may allow Menomonee Falls to sell or exchange well water or ground water on a wholesale or retail basis to any other municipality in existence as the date of this agreement or to any properties therein with the exception of the agreements already entered into by Menomonee Falls as listed in Exhibit B and the Village of Lannon and to offer emergency water service."
