Title
Substitute resolution authorizing the City of Milwaukee to accept an easement from Miller Brewing Company for the purpose of providing a through pedestrian path on Miller's property on both sides of West State Street just east of North 45th Street due to the presence of concrete bases for a sign bridge spanning West State Street, in the 16th Aldermanic District of the City of Milwaukee.
Analysis
This resolution accepts an easement from Miller Brewing Company for public pedestrian usage on their property on both sides of West State Street in the vicinity of concrete bases for a sign bridge to be located just east of North 45th Street.
Body
Whereas, Miller Brewing Company (Miller) has determined that it is necessary to have a sign bridge span West State Street, at a point approximately 140 feet east of North 45th Street, as a part of an ambiance-creating enhancement upgrade in conjunction with the City of Milwaukee's paving project of West State Street, between North 35th Street and North 60th Street (West City limits); and

Whereas, Due to the size and the location of the proposed supports for this sign within the public sidewalk areas on both sides of the street, public pedestrian movements will be impeded; and

Whereas, This has prompted Miller to indicate their willingness to allow said pedestrians to walk on its property and have agreed to grant a pedestrian easement to the City of Milwaukee; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee that by adoption of this resolution the City agrees to the agreement for pedestrian easement as described in exhibit B and shown in exhibit C under the terms of exhibit D;

and, be it

Further Resolved, That the proper City officials are authorized and directed to sign the agreement;
