Common Council File No. 950562, passed September 27, 1995, amended the charter to eliminate the remarriage penalty for widows or widowers receiving accidental death benefits. Prior to that ordinance, the accidental death benefits of a widow or widower ceased when the recipient remarried. This charter ordinance deletes a remaining charter reference to the remarriage penalty to clarify that the remarriage penalty has been eliminated.
BODY:
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
Part 1. Section 36-05-5-a-1 of the code is amended to read:
36-05. Benefits.
5. ACCIDENTAL DEATH BENEFIT.
a. Spouse or Child's Annuity.
a-1. His widow [[of]] >>or<< her widower [[to continue during his or her widowhood]] ; or
Part 2. This is a charter ordinance and shall take effect 60 days after its passage and publication, unless within such 60 days a referendum petition is filed under s. 66.01(5), Wis. Stats., in which event this ordinance shall not take effect until submitted to a referendum and approved by a majority of the electors voting thereon.
