Analysis

This ordinance creates an exemption for vendors selling articles from parked vehicles on the public highway or sidewalk. Currently, if a vendor is invited to sell articles from a vehicle on the public highway or sidewalk by the organizer of an event who has obtained a special event permit from the department of public works, there is no exemption for selling articles from a vehicle on the public highway or sidewalk, even within the footprint of the event. This ordinance creates an exemption for vendors who have been invited by the organizers of an event who have been granted a special event permit by the department of public works to sell articles from a parked vehicle on the public highway or sidewalk within the footprint, and for the duration of, the event.

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

 

Part 1. Section 115-45-1-c of the code created to read:

 

115-45. Selling Articles from Parked Vehicles.

1. REGULATIONS.

c. Exemption. At a special event for which the department of public works has issued a special event permit, a vendor who has been granted permission by the organizers of the event to sell articles on the public highway or sidewalk encompassed by the footprint of the event shall be exempt from the regulations of this subsection for the duration of the event.
