Title
Resolution authorizing and directing the proper City of Milwaukee officials to execute an agreement with RDAR Corporation (RDAR) which gives RDAR two abandoned railroad bridges.
Analysis
This resolution gives RDAR two abandoned railroad bridges that the City currently owns, one over East Lincoln Avenue and one over East Becher Street. RDAR will remove the East Lincoln Avenue bridge and utilize the East Becher Street bridge for its operations.
Body
Whereas, Two former Union Pacific Railroad Company bridges, one over East Lincoln Avenue and one over East Becher Street, connect to RDAR's land; and

Whereas, The City owns these two former railroad bridges; and

Whereas, RDAR desires to have the bridge over East Lincoln Avenue removed to allow better truck access to the property; and

Whereas, RDAR desires to utilize the bridge over East Becher Street for operations on the property; and

Whereas, The City desires to develop a bicycle trail through or along RDAR's property; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the proper City of Milwaukee officials are authorized and directed to execute an agreement with RDAR which gives RDAR the two abandoned railroad bridges under the terms and conditions specified in the agreement attached to Common Council File Number 040623 and incorporated in this resolution by reference as though set forth in full; and, be it

Further Resolved, That the City Comptroller is directed to submit the Agreement to the Milwaukee County Register of Deeds for recording against the property described in the Agreement; and, be it

Further Resolved, That the Commissioner of Public Works is authorized to make minor, non-substantive changes to the Agreement prior to its execution.
