Analysis
This resolution approves the execution of an Access Easement Agreement with COFCO International Grains US LLC regarding an access road on Port Milwaukee, in the 14th Aldermanic District.
Body.
Whereas, COFCO International Grains US LLC (“COFCO”) owns property adjacent to Port Milwaukee located at 960 E. Bay Street, Tax Parcel No. 4639996210 (“Property”); and
Whereas, The Property is landlocked, with no public right of way access; and
Whereas, The City of Milwaukee, acting through its Board of Harbor Commissioners, executed an Easement and Agreement in 1961 with the former owner of the Property for use of a Port Milwaukee access road that connects the Property to the public right of way; and
Whereas, The 1961 Easement and Agreement is no longer in effect; and
Whereas, In exchange for the execution of a new Access Easement Agreement to benefit itself and its successors, COFCO has agreed to share the maintenance and repair costs of the access road with Port Milwaukee as more specifically described in the Access Easement Agreement; and
Whereas, Pursuant to Wis. Stat. § 30.38(4), title to harbor lands and facilities shall vest in the municipality, which requires any encumbrance on title to be approved by the City; and
Whereas, The Board of Harbor Commissioners has approved the Access Easement Agreement; and
Whereas, The Office of the City Attorney has reviewed the proposed Access Easement Agreement, a copy of which is attached hereto; now, therefore, be it
