Analysis

This resolution authorizes the proper City officers to execute a Quit Claim Deed (QCD-2884) document conveying the sanitary and combined sewers located in vacated West Rogers Street west of South 1^st Street, in the 14^th Aldermanic District. The sewers are being conveyed because they are no longer serving multiple properties.

Body

Whereas, West Rogers Street between South 1^st Street and a point west was vacated on October 3, 1978 by Common Council File Number 771705; and

Whereas, The City of Milwaukee owns a 10-inch diameter sanitary sewer and a 15-inch diameter combined sewer in said vacated West Rogers Street; and

Whereas, The vacated lands are now owned by of Becher Development, LLC; and 

Whereas, Said sewers no longer serve the interest of the City; and

Whereas, Becher Development, LLC has agreed to accept ownership of said sewers; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the proper City officials, including the DPW Commissioner, are hereby authorized: (i) to sign the Quit Claim Deed document (QCD-2884), in the form and substance submitted to this file (or in substantially the same form and substance as submitted, and to effectuate the intent of this resolution); and (ii) to cause the same to be recorded in the Milwaukee County Register of Deeds Office.
