Substitute resolution designating the Redevelopment Authority of the City of Milwaukee as agent of the City of Milwaukee to perform all acts currently performed by the City Plan Commission regarding Tax Increment Law, Wisconsin Statutes, Section 66.1105.
Analysis
As authorized under Wisconsin Statutes, Section 66.1105, this substitute resolution designates the Redevelopment Authority as the agent of the City to conduct the required public hearings and take such other actions as are now performed by the City Plan Commission when a tax incremental district is created. The Redevelopment Authority typically implements the blight elimination, public improvement and project financing aspects of most tax incremental district Project Plans; however, it now has no role in the initial review and approval of those Plans.

The City Plan Commission currently performs this review and approval function. With the exception of zoning and master plan matters, the City Plan Commission typically has no actual role in implementing the TID Plans.

As permitted by Wisconsin Statutes, Section 66.1105(3)(f), this change will facilitate implementation of TID Plans by having the initial review of the Plans conducted by the agency charged with implementing them, the Redevelopment Authority of the City of Milwaukee.

Whereas, Wisconsin Statutes, Section 66.1105, authorizes cities to create Tax Incremental Districts (“TID's”); and

Whereas, The approval of the Project Plan (“Plan”) for TID's requires a public hearing and consideration by the City's Plan Commission; and

Whereas, With the exception of zoning matters, the City Plan Commission generally has no subsequent role in implementing the Plan for a given TID, i.e., constructing public improvements, providing financing for the project, or eliminating blight; and
