Title
Resolution approving Facilities Use and License Agreement with Metricom, Inc.

Analysis
This resolution authorizes the execution of a Facilities Use and License Agreement (FULA) between the City and Metricom, Inc. Metricom operates a wireless internet service known as Ricochet. That service transmits wireless internet service via radios attached to facilities located in the public right-of-way. Under the FULA, the City would provide Metricom with the right to attach to City facilities in the right-of-way in return for which Metricom would pay the City $110 per attachment. This would be annually increased by 6% starting in the second year of an initial 10-year term. Metricom would pay half of these fees for attachments to facilities which are under joint ownership between the City and the Wisconsin Electric Power Company. The final number of attachments would be determined in accordance with the terms of the agreement and subject to the review and approval of the Commissioner of Public Works.

Whereas, Metricom, Inc., owns and operates a mobile digital communications radio network known as "Ricochet" which utilizes radio transmitters to provide wireless internet services; and

Whereas, Metricom, Inc., wishes to locate, place, attach, install and operate radios for this service on facilities owned by the City which are located within the public right-of-way; and

Whereas, The City is willing to permit Metricom to locate, place, attach, install, operate and maintain such radios on City-owned facilities within the right-of-way in accordance with the terms and conditions of the Facilities Use and License Agreement (FULA) attached to this file; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the proper City officials are authorized and directed to execute the FULA attached to this file.
