- Analysis -
This ordinance provides that the commissioner of building inspection shall issue an order to correct defective work whenever elevator installation is performed contrary to the city's elevator code. It further provides that the commissioner may withhold future permits whenever an elevator contractor fails to:
a. Comply with an order to correct defective work.
b. Perform elevator work within a reasonable period of time after the issuance of a permit.
c. Promptly respond to official communication from the commissioner.
This ordinance also permits the installation of sump pumps in elevator shaftways that are located at or below grade.
BODY:
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
Part 1. Section 222-52-5 of the code is created to read:
222-52. Construction Permits.
5. WITHHOLDING OF PERMITS. a. Whenever any elevator installation occurs contrary to the regulations of this chapter, the commissioner shall issue an order to remedy the defective work to the violator at his or her last known address. Failure to comply with the order shall be deemed sufficient reason for withholding future permits, in addition to other penalties provided in this code.
b. The commissioner may also withhold future permits whenever an elevator contractor fails to:
b-1. Perform elevator work within a reasonable period of time after the issuance of a permit.
b-2. Promptly respond to official communication from the commissioner.
Part 2. Section 222-58 of the code is amended to read:
