Body
Whereas, Inland Commercial Property Management, Inc. requested permission to keep and maintain a retaining wall in the west sidewalk area of North 68th Street; and

Whereas, Permission for said retaining wall was granted in 1999 under Common Council File Number 981321; and

Whereas, Lake Cook - Sequoia Shopping Center, LLC now owns the property; and

Whereas, For the liability to be formally transferred to the current property owner, the Common Council needs to adopt an amending resolution; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that Common Council File Number 981321 is hereby rescinded; and, be it

Further Resolved, That Lake Cook - Sequoia Shopping Center, LLC, 150 Inverness Court, Lake Bluff, Illinois 60044, is hereby granted the following special privilege:

To keep and maintain a retaining wall projecting 1-foot into the west, 10-foot wide sidewalk area of North 68th Street. Said retaining wall commences at the southline of West Brown Deer Road and extends south approximately 130 feet. The concrete block retaining wall varies in height between 1 foot 6 inches and 4 feet 8 inches.

Said above-mentioned retaining wall shall be used, kept and maintained to the satisfaction of the Commissioners of Public Works and Department of Neighborhood Services.

Said retaining wall shall be maintained or removed from the public right-of-way, at such future time as they are no longer needed, to the satisfaction of the Commissioners of...
