This substitute resolution authorizes the Commissioner of Public Works to execute three Memorandums of Understanding with the Milwaukee Metropolitan Sewerage District (MMSD) regarding the design, construction and maintenance of improvements to reduce the flooding of Lincoln Creek.
Body
Whereas, The Lincoln Creek has experienced flooding during large rain events; and

Whereas, The Milwaukee Metropolitan Sewerage District (MMSD) has jurisdiction over Lincoln Creek; and

Whereas, MMSD has performed engineering studies and developed the Lincoln Creek Environmental Restoration and Flood Control Project to reduce the flooding of Lincoln Creek; and

Whereas, MMSD is in the process of designing and awarding construction contracts for the improvements outlined in the Lincoln Creek Environmental Restoration and Flood Control Project; and

Whereas, Some of the improvements required by the Lincoln Creek Environmental Restoration and Flood Control Project will involve modifications to or removal of City of Milwaukee infrastructure; and

Whereas, Three Memorandums of Understanding have been prepared which specify the responsible party for the design, construction and maintenance of these improvements; and

Whereas, The City has tentatively agreed to the maintenance of the new North 37th Street pedestrian bridge provided Milwaukee County accepts ownership and maintenance of Kilbourn Park and any land added to this park; now, therefore, be it
