Analysis
This resolution approves an Out-of-Program Agreement between Harley-Davidson and the City of Milwaukee regarding design, implementation, and inspection of water main alterations necessitated by the company's planned museum project at North 6th and West Canal Streets. The company would provide all up-front funds required to complete the alterations. The City would design the improvement, award the contract for the work, and inspect the improvements as they are made. Under the terms of the City's Development Agreement with the company, the City would pay the company back for the cost of these public improvement activities as tax increments are generated by the museum project.
Body
Whereas, H-D Milwaukee, LLC, an affiliate of Harley-Davidson Inc., intends to develop a corporate museum on City of Milwaukee property located easterly of South 6th Street at West Canal Street extended; and

Whereas, To accommodate the planned museum, the City must vacate the site and must relocate or abandon certain water facilities located thereon; and

Whereas, The company and the City have entered into (or intend to enter into) a Development Agreement which outlines the responsibilities of both parties in completing the museum project; and

Whereas, The Development Agreement stipulates that the company provide the initial funds for all on-site public improvements needed to accomplish the project and that the City over time reimburse the company through tax increments generated by the development; and
