Title
Resolution approving an exception to City requirement that sidewalks be developed in conjunction with the construction of all new streets.
Analysis
Section 113-12.5 of the Milwaukee Code of Ordinances requires that sidewalks be installed on both sides of any new street to be constructed by the city. This section also provides that the Common Council may waive or defer this requirement. A developer is proposing a new single-family home subdivision in the area generally located between 122nd and 124th Streets north of Good Hope Road, and has requested that the requirement for sidewalks in the proposed subdivision be waived. This resolution waives the sidewalk requirement.
Body
Whereas, Weas Development has proposed development of a single-family residential subdivision in the area generally located between 122nd and 124th Streets north of Good Hope Road; and
Whereas, This subdivision, to be known as Heritage Hills, would include construction of several new public streets; and
Whereas, Section 113-12.5 of the Milwaukee Code of Ordinances requires that sidewalks be installed on both sides of any new street constructed in the city; and
Whereas, This section also provides that the Common Council may waive the sidewalk requirement on a case-by-case basis; and
Whereas, The developer has requested that the sidewalk requirement be waived for the project due to the cost of sidewalk construction and the desire to create a suburban feel to the subdivision; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the requirements of
s. 113-12.5 pertaining to sidewalk installation in conjunction with new city streets are waived for the proposed Heritage Hills subdivision.
