This resolution approves a Third Amendment to Lease Agreement with Verizon Wireless for the installation and operation of communication and ancillary equipment at the Hawley Road Water Tower at 1235 North 57th Street.
Body
Whereas, Pursuant to Common Council File Number 971409 adopted on March 3, 1998, the City and Verizon Wireless entered into a lease agreement with PrimeCo Personal Communications, L.P. for the installation and operation of communication and ancillary equipment at the Hawley Road Water Tower at 1235 North 57th Street.
Whereas, The Common Council File Number 030075 adopted on May 13, 2013, approved a First Amendment to Lease Agreement that addressed rent; and
Whereas, The Common Council File Number 080810 adopted on December 16, 2008, approved a Second Amendment to Lease Agreement for additional ground space at the property; and
Whereas, The Milwaukee Water Works and the City Attorney’s Office negotiated a Third Amendment to Lease Agreement with Verizon Wireless relating to extending the term of the lease; and
Whereas, Under this amendment one extension term of five years and three option terms of five years each will extend the term of the lease; and
Whereas, The third lease amendment offers a fair market value to the City, protects other City interests, and is acceptable to all City participants; now, therefore, be it;
Resolved, By the Common Council of the City of Milwaukee, That the Common Council approves a Third Amendment to Lease Agreement with Verizon Wireless at the Hawley Road Water Tower at 1235 North 57th Street, a copy of which is attached to this file, and authorizes the proper City officials to enter into said agreement on behalf of the C...
