Analysis
This resolution permits the City of Milwaukee to execute easements to facilitate sidewalk improvements.
Body
Whereas, The Wisconsin Department of Transportation (“WisDOT”) presented the City of Milwaukee (“City”) with an offer to acquire a permanent limited easement (“PLE”) and a temporary limited easement (“TLE”) at the City-owned properties at 8505 West Appleton Avenue and 8520 ADJ West Appleton Avenue (the “Properties”); and

Whereas, The WisDOT easement request includes the right to preserve, protect, remove, or plant thereon any vegetation that the highway authorities may deem desirable, to make or construct improvements on said lands or to flatten the slopes, operate necessary equipment thereon and the right of ingress and egress; and

Whereas, The requested PLE of 8 square feet (“SF”), more or less, will run with the land, and 62 SF and 107 SF, more or less, for the TLE will terminate upon the completion of this project or on the day the highway is open to the traveling public, whichever is later; and

Whereas, The appraisal presented by WISDOT has been reviewed by the City Real Estate staff and the offering values have been determined to be reasonable consideration for both the PLE and TLE; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of the Department of City Development, or designee, is authorized to execute said easements with WISDOT; and, be it

Further Resolved, That, at closing, the easement proceeds will be retained by the City and deposited in the City’s Tax Deficit Fund.
