Body
Whereas, Common Council File No. 020610, adopted August 1, 2002, authorized the City Attorney to enter into an outside legal counsel services agreement with the law firm of Michael, Best & Friedrich, LLP for purposes of defending the City of Milwaukee against those challenges to acquisition and relocation matters in the Park East Freeway Demolition Project; and

Whereas, Such agreement was entered into on August 20, 2002 and provided for expenditures of up to $50,000.00 from the Project/Grant Fund Number ST 32002420; and

Whereas, To date, litigation on the four commercial properties acquired for the project have resulted in numerous court-ordered mediation sessions, a hearing in front the Milwaukee County Condemnation Commission, an appeal by one of the property owners of a trial court decision in favor of the City on a Writ of Assistance, and the potential that two of the properties will go on to trial before a jury; and

Whereas, The firm of Michael, Best & Friedrich, LLP, and a firm of Gonzalez, Saggio & Harlan, LLC (performing delegated legal services activities as in emerging business enterprise) have provided services which will exceed the $50,000.00 agreement amount; and

Whereas, The City Attorney recommends that an additional $50,000.00 be authorized from the above account and the agreement be amended to provide a maximum of $100,000.00; now, therefore, be it
