Body
Whereas, The claimant, Miller Brewing Company, sustained damages during an excavation project in the area of 4100 West State Street; and
Whereas, A negotiated settlement which is favorable to the City has been arrived at; and
Whereas, The City Attorney recommends and the Common Council of the City of Milwaukee deems it expeditious and just to settle this claim; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the proper City officers be and hereby are authorized and directed to issue a City check in the amount of $50,000.00, payable to the order of Miller Brewing Company, in full and final settlement of the plaintiff's claims against the City of Milwaukee, upon receipt of a release of liability, approved as to form and execution by the City Attorney; said amount to be charged to the Engineer Project Fund Account No. 0333, 5234 R999 ST32090210.
