Analysis
This resolution authorizes settlement of Nelson, et al v. City of Milwaukee, et al, United States District Court, Eastern District of Wisconsin, case number 03 C 0984 in the amount of $80,000.00 in exchange for releases by all eleven plaintiffs for all damages whatsoever, including attorneys fees and costs, concerning all claims that plaintiff brought or could have been brought in connection with the 2002 promotional examination for Fire Captain.
Body
Whereas, The plaintiffs, James D. Nelson, James W. Heller, Scott F. Franken, Scott M. Van Roo, Kenten K. Kais, James L. Merchant, Richard A. Kaiser, Luke Jones, Frank D. Alioto, Michael E. Nowak and James S. Mueller, filed discrimination charges with the Equal Employment Opportunity Commission (EEOC), and the Equal Rights Division of the State of Wisconsin, Department of Workforce Development (ERD),), and then filed suit in the United States District Court for the Eastern District of Wisconsin, claiming race and gender discrimination based upon the administration and results of the 2002 Fire Captain promotional examination; and

Whereas, The parties have agreed to settle this lawsuit in the amount of $80,000.00 in exchange for dismissal of all claims, as setforth in the attached proposed Settlement Agreement and Release; and

Whereas, The City Attorney recommends and the Common Council of the City of Milwaukee deems it is expeditious and just to settle this lawsuit; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the City Attorney be and hereby is authorized to execute the attached Settlement Agreement; and, be it
