Body
Whereas, The plaintiff, Dillingham Construction N.A., Inc., has filed a lawsuit against the City of Milwaukee seeking damages in the amount of $3,434,657.41 plus interest; and
Whereas, The City Attorney recommends and the Common Council of the City of Milwaukee deems it expeditious and just to settle this lawsuit; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the proper City officers be and hereby authorized and directed to issue a City check in the amount of $750,000.00, payable to the order of Dillingham Construction N.A., Inc. and its attorneys, O'Neil, Cannon & Hollman, S.C., in full and final settlement of this lawsuit, upon receipt of a release of claims, approved as to form and execution by the City Attorney, $24,586.91 of said amount to be charged to Account No. 0327-5010-0001R999000-SW17180101-000600, and the remainder to be charged to the Damages and Claims Fund, Account No. 0001-1490-636506-2631-S118-2000.
