Body
Whereas, The plaintiff Gail O’Neil had commenced a lawsuit against the City of Milwaukee seeking damages of $89,233.00 for replacement of personal property and for building restoration costs; and
Whereas, The plaintiff sustained damages in an incident involving work to the sewer in the immediate vicinity of the plaintiff’s residence; and
Whereas, Sewer and water backed up into plaintiff’s basement causing structural damage and destruction of personal property; and
Whereas; A settlement favorable to all parties has been reached; and
Whereas, The City Attorney recommends and the Common Council of the City of Milwaukee deems it expeditious and just to pay this verdict; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, That the proper City officers be and are hereby authorized and directed to issue a City check in the amount of $48,000.00, payable to the client Trust Account of Rose & deJong, in full and final settlement of this claim, upon receipt of a release of claims, approved as to form and execution by the City Attorney, said amount to be charged to the Damages and Claim Fund, Account No. 006300 0001 1490 2631 S118-2005.
