Analysis
This Resolution authorizes an amendment to the Quit Claim Deed for the State Park Project increasing the size of the one building to be constructed by the State of Wisconsin from not more than 1,500 s.f. to not more than 2,500 s.f.
Body
Whereas, Common Council File No. 040398 approved the Lakeshore State Park Project and authorized the execution of documentation necessary for the Project, including a Quit Claim Deed to Harbor Island; and
Whereas, The Quit Claim Deed for Harbor Island contained a restriction stating that “no above grade structures shall be constructed by Grantee upon the Property, with the exception of one building of not more than 1,500 s.f. to house restroom and shower facilities, and office for the Lakeshore State Park and display areas …”; and
Whereas, The Wisconsin Department of Natural Resources has requested an amendment to the foregoing restriction allowing construction of one building of not more than 2,500 s.f. in order to serve the needs of the Lakeshore State Park; and
Whereas, The Board of Harbor Commissioners of the City of Milwaukee approved an Amendment of Restriction on January 19, 2007; and
Whereas, Pursuant to Wis. Stat. § 30.38 (4) and § 30.38 (6), a Common Council must approve such agreements and instruments; now, therefore, be it
Resolved, The Common Council of the City of Milwaukee, hereby approves the Amendment of Restriction (Quit Claim Deed - Island) in the form on file with the Common Council and further authorizes the proper City officers to execute such amendment on behalf of the City of Milwaukee.
