Resolution approving a License Agreement with Growing Power, Inc. to permit an urban produce garden on a portion of excess land at Engine Company No. 5 at 1313 West Reservoir Avenue, in the 15th Aldermanic District.
Analysis
This resolution approves a License Agreement to permit a produce garden on City-owned property.
Body
Whereas, Growing Power, Inc. has identified approximately 9,600 square feet of excess land adjacent to Milwaukee Fire Department (“MFD”) Engine Company No. 5 at 1313 West Reservoir Avenue that is a suitable site for an urban garden; and

Whereas, Growing Power has requested a five-year term during which it will build four hoop houses and operate the garden; and

Whereas, MFD has entered into a Memorandum of Understanding with Growing Power in which MFD agrees to provide access to water and storage facilities and Growing Power will reimburse MFD for water usage and provide fresh vegetables to Engine Company No. 5; and

Whereas, The City of Milwaukee (“City”) has negotiated a License Agreement with Growing Power, a copy of which is attached to this Common Council File; and

Whereas, MFD and the community will benefit by using excess land to promote urban gardening and increase the supply of locally grown vegetables; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the License Agreement with Growing Power, Inc. for a portion of the property at 1313 West Reservoir Avenue is approved; and, be it

Further Resolved, That final construction and site plans must be approved by the Department of City Development (“DCD”) and MFD prior to hoop house installation; and, be it

Further Resolved, That the City Attorney’s office, in cooperation with the Commissioner of DCD, is authorized to make minor modifications to the License Agreement that are consistent with the intent of this resolution; and, be it
