Title
Resolution approving the execution of a nonexclusive pedestrian and bicycle easement agreement with FS Apartments, LLC regarding access through the FS Apartments property, in the 14th Aldermanic District.
Analysis
This resolution approves the execution of a nonexclusive pedestrian and bicycle easement agreement between the City of Milwaukee, a Wisconsin municipal corporation, and FS Apartments, LLC, a Wisconsin limited liability company, regarding access through the FS Apartments property, in the 14th Aldermanic District.
Body
Whereas, FS Apartments, LLC (the “Grantor”) owns the property located at 147 East Becher Street, Milwaukee, Wisconsin 53207 (the “Property”); and

Whereas, Common Council Resolution File No. 230625, adopted September 19, 2023, approved the Project Plan for Tax Incremental District No. 117 in order to provide for the funding of certain TID No. 117 project costs within the district; and

Whereas, The Project Plan requires the Grantor to construct an off-street bike path through the Property and provide the City with a non-exclusive permanent easement for its use; and

Whereas, The City of Milwaukee (“City”) has negotiated and agreed to the attached terms with Grantor for an easement of ingress and egress on a non-exclusive basis in common with Grantor over and across a portion of land on the Property for public access through the Property; and

Whereas, The Office of the City Attorney has reviewed the proposed Easement Agreement, a copy of which is attached hereto; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the nonexclusive pedestrian and bicycle easement agreement is hereby approved; and, be it

Further Resolved, That the proper City officials are hereby authorized to execute the nonexclusive pedestrian and bicycle easement agreement in substantial conformity to the agreement submitted alongside this file,...
