Substitute resolution relating to designated sites for cruising.
Analysis
This resolution creates a pilot “Cruising Allowed” program in which cruising would be allowed along Capitol Drive between North 5th Street and North Humboldt Boulevard on Friday, Saturday and Sunday nights between 10 p.m. and 3:30 a.m. The Police Department is requested to suspend enforcement of cruising-prohibition code provisions in this location and at these times. The Police Department is also requested to suspend enforcement of noise-nuisance and parking regulations at the same times in the same location. In addition, the Department of Public Works is directed to suspend enforcement of parking regulations at these times in this location. This pilot program would be in effect from July 16, 2004 through September 27, 2004.

Whereas, Cruising -- repetitive driving along major thoroughfares -- has been a persistent problem in particular areas of the City of Milwaukee for several years; and

Whereas, Many of the youths who engage in cruising do so because they seek opportunities to congregate and socialize and feel that cruising is the best or only option available to them; and

Whereas, To alleviate cruising-related problems in other parts of the city, the Common Council finds that there may be merit in the idea of designating a particular street as a “Cruising Allowed” zone if that street is located in a non-residential area and if on-street parking is not generally needed during the hours when cruising would be allowed; and

Whereas, The Common Council finds that enforcement of the cruising, noise and parking regulations along Capitol Drive between North 5th Street and North Humboldt Boulevard on Friday, Saturday and Sunday nights between the hours of 10 p.m. and 3:30 a.m. is not essential to protection of the public health, safety and welfare; now, therefore, be it
