This resolution directs the Department of City Development to prepare a resolution which vacates said right-of-way in accordance with vacation proceedings under power granted to the City of Milwaukee by Section 66.297(1), Wisconsin Statutes, and Section 81-308-28, Milwaukee Code of Ordinances. This vacation is necessary to eliminate encroachments of decorative fencing and monument signage into the right-of-way for a condominium development.
BODY:
Whereas, It has been proposed by the Department of City Development that excess right-of-way between the property line and sidewalk in the block bounded by North 4th Street, West Vine Street, North 5th Street and West Reservoir Avenue be vacated pursuant to the provisions of Section 66.297, Wisconsin Statutes; and
 
Whereas, The vacation of said right-of-way is necessary to eliminate encroachments; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee that the Department of City Development is directed to prepare a resolution to vacate said right-of-way in accordance with Section 81-308-28 of the Milwaukee Code of Ordinances.
