Analysis
This ordinance amends the sections of the code regarding exceptions to the installation of sidewalks. The common council may waive the sidewalk requirement when an applicant or applicants demonstrate by clear and convincing evidence that the presence of a sidewalk will be detrimental to the health, safety and welfare of the public.
Body
The Mayor and Common Council of the City of Milwaukee do ordain as follows:

Part 1. Section 113-12.5 of the code is amended to read:

113-12.5. Sidewalks, When and Where Laid; Exceptions. Concrete sidewalks shall be installed on both sides of any street whenever said street is improved by installing permanent pavement, curb and gutter; provided, however, that the common council may waive [[or defer]] this requirement >>if an applicant or applicants demonstrate by clear and convincing evidence that the presence of a sidewalk will be detrimental to the health, safety and welfare of the public<<.

Part 2. Section 119-12-1-c of the code is amended to read:

119-12. Required Improvements.

1. AGREEMENT WITH CITY.

c. Concrete sidewalks along both sides of every street in a residentially zoned area, and along at least one side of every street in areas zoned other than residential shown on the plat, in accordance with applicable standard specifications of the department of public works; provided, however, that the common council may waive [[or defer]] any or all of these requirements >>if an applicant or applicants demonstrate by clear and convincing evidence that the presence of a sidewalk will be detrimental to the health, safety and welfare of th...
