Title
A substitute ordinance relating to increasing the fee for a Class "D" Operator's license and providing for retention of a portion of an applicant's license fee under certain circumstances.

Analysis
This ordinance:
1. Increases the 2-year Class "D" Operator's (bartender's) license from $42 to $60 (the current fee has been in effect since 1988).
2. Provides for retention of $30 of an applicant's license fee (new and renewal) for investigation-administration expenses in those cases where an applicant withdraws the application or is denied by the common council.
BODY:
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
Part 1. Section 81-31-1 of the code is amended to read:
Class "D" Operator's License. 1. The fee for each Class "D" operator's license shall be [[$42]] >>$60<<.

Part 2. Section 90-5-4-d of the code is amended to read:
90-5. Licensing.
4. DEPOSIT OF FEE; REFUND. d. Upon the withdrawal or the proper license committee's denial of a Class "A" or Class "B" liquor license application [[or]] >>,<< Class "A" fermented malt beverage license application >>or Class "D" Operator's license,<<, the amount of $50 >>($30 in the case of a Class "D" Operator's license)<< of the application fee shall be retained by the city treasurer to defray the cost of investigation of facts and administration thereof. The remainder of the application fee for [[Class "A" or Class "B" liquor or Class "A" fermented malt beverage]] >>these<< licenses and deposits on all applications denied by the common council shall be refunded by the city treasurer upon surrender of the deposit receipt certified by the city clerk, provided that the certified deposit receipt is surrendered no later than one year after the date of the license denial.
