THE CLERK swore in the Court Reporter.
RENEWAL WITH A 30 DAY SUSPENSION OF THE CLASS "B" TAVERN LICENSE OF JANE M. POINTER FOR THE PREMISES AT 4221 W. CAPITOL DRIVE, "M&J CAP TAP" (10TH DISTRICT)
NONRENEWAL OF THE CLASS "D" BARTENDER RENEWAL LICENSE OF ANTHONY T. HAYES.
DENIAL OF THE HOME IMPROVEMENT CONTRACTOR LICENSE OF JOHN WEISENBERGER FOR "JOHN WEISENBERGER CONSTRUCTION" AT 4232 W. PECK PL.
THE CHAIR questioned whether all members of the Common Council present at the meeting had read the report and recommendation of the Utilities and Licenses Committee and written exceptions, if filed, relative to the foregoing recommendations.
A roll call vote showed the following results:
Ayes: 17 - Ald. Pratt, D'Amato, Henningsen, Schramm, Johnson-Odom, Gordon, Frank, Richards, Butler, Scherbert, Witkowiak, Pawlinski, Breier, Nardelli, Murphy, Hines and President Kalwitz.
THE CHAIR questioned whether Jane Pointer-- or her counsel was present and wished to addressed the Council.
Both were present.
ALD. BREIER moved that the Common Council do now resolve itself into a Committee of the Whole for the purpose of hearing from the counsel and Assistant City Attorney.
PROCEEDINGS OF THE COMMITTEE OF THE WHOLE
Attorney Michael Clarke and Assistant City Attorney Bruce Schrimpf appeared and addressed the Committee relative to the foregoing matter.
ALD. Witkowiak moved that the Committee do now rise.
The motion prevailed.
ALD.GORDON moved to amend the recommendation for renewal with a 10 day suspension.
THE motion failed by the following vote:
Ayes: 8 - Ald. Pratt, D'Amato, Johnson-Odom, Gordon, Butler, Scherbert, Murphy and Hines.
Noes: 9 - Ald. Henningsen, Schramm, Frank, Richards, Witkowiak, Pawlinski, Breier, Nardelli and Kalwitz.
ALD. GORDON moved to approve the original recommendation for renewal with a 30 day suspension.
The motion prevailed by the following vote:
Ayes: 17 - Ald. Pratt, D'Amato, Henningsen, Schramm, Johnson-Odom, Gordon, Frank, Richards, Butler, Scherbert, Witkowiak, Pawlinski, Breier, Nardelli, Murphy Hines and President Kalwitz.
THE CHAIR asked whether the following applicant or his attorney were present and wished to address the Council.
Attorney T. Hayes was present.
ALD. GORDON moved to approve the Utilities and Licenses recommendations for nonrenewal.
THE CHAIR asked whether the following applicant or his attorney were present and wished to address the Council.
John Weisenberger.
Neither was present.
ALD. BUTLER moved to refer the foregoing application back to committee.
The motion prevailed by the following vote:
