- Analysis -

 

Charter ordinance 960457 permitted members of the employes' retirement system effective on or after January 1, 1995 to elect any option with the member's spouse as a designated survivor. It also permitted policemen or firemen who elected a spouse option after January 1, 1995 to reselect an option. This charter ordinance permits firemen who retired on or after January 1, 1995 and elected a protective survivorship option payable to their spouse prior to January 1, 1995 to reselect the protective survivorship option.

BODY:

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

 

Part 1. Firemen who affirmatively elected a protective survivorship option prior to January 1, 1995, who, at this time of such affirmative selection had a spouse, who subsequently retired on a service retirement allowance after January 1, 1995 shall be given up to 30 days following the effective date of this charter ordinance to reselect the protective survivorship option payable to their spouse.

 

Part 2. This is a charter ordinance and shall take effect 60 days after its passage and publication, unless within such 60 days a referendum petition is filed as provided in s. 66.01(5), Wis. Stats., in which event this ordinance shall not take effect until submitted to a referendum and approved by a majority of the electors voting thereon.
