Title
A substitute ordinance relating to penalties for violations of fireworks provisions.

Analysis
This ordinance:
1. Increases the penalty range for violating the city’s fireworks code provisions from $100 - $500 to $500 - $1,000.
2. Imposes a penalty of not more than $1,000 on a parent or legal guardian of a minor who consents to the use of fireworks by the minor.

Part 1. Section 105-47-3 of the code is repealed and recreated to read:
105-47. Fireworks.
3. PENALTY. a. Any person violating this section shall upon conviction forfeit not less than $500 nor more than $1,000, and upon default thereof shall be imprisoned in the county jail or house of correction for a period not to exceed 40 days, or until the forfeiture costs are paid.
b. A parent or legal guardian of a minor who consents to the use of fireworks by the minor shall forfeit not more than $1,000, and upon default thereof shall be imprisoned in the county jail or house of correction for a period not to exceed 40 days, or until the forfeiture costs are paid.
