This resolution authorizes settlement of the lawsuit entitled Allen R. Lane v. Board of Fire and Police Commissioners for the City of Milwaukee, Circuit Court Case No. 98-CV-001935 and Case No. 98-CV-002599 in the amount of $18,689.11 which represents attorney's fees and costs.

BODY:
Whereas, The plaintiff, Allen R. Lane, was disciplined by the Milwaukee Police Department, and appealed said discipline to the Board of Fire and Police Commissioners ("FPC"), who sustained the Chief's charges and Allen R. Lane appealed the FPC decision to the Circuit Court of Milwaukee County, Milwaukee, Wisconsin; and
Whereas, The Circuit Court, Honorable Diane S. Sykes, reversed the decision of the FPC; and
Whereas, The Circuit Court, Honorable Diane S. Sykes, ordered that the defendant reimburse plaintiff's costs and reasonable attorney's fees in connection with the defense and appeal at the rate of $150.00 per hour, a rate the court found to be reasonable; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the proper city officers be and hereby are authorized and directed to issue a city check in the amount of $18,689.11 payable to the order of Machulak, Hutchinson, Robertson, O'Dess & Reilly, S.C., Attorneys at Law in the full and final settlement of this lawsuit, upon receipt of a release of claim approved as to form and execution by the City Attorney, that said funds shall be appropriated from the Damages and Claims Fund: Fund 0001, Org 1490, Program 0001, Sub- Class S118, Account 006300.
