Whereas, The plaintiff, Mews Companies, Inc., filed a lawsuit against the City of Milwaukee in 1995 seeking damages in the amount in excess of $130,000.00 plus interest; and
Whereas, After trial, Mews Companies, Inc. was awarded $66,200.00 plus retainage, and the City was awarded $6,800.00 on its counterclaim; and
Whereas, Judgment was entered against the City in 1998 in the amount of $70,200.00 plus post-verdict interest; and
Whereas, An appeal was filed and the matter was ultimately remanded for the imposition of pre-verdict interest; and
Whereas, The City Attorney recommends and the Common Council of the City of Milwaukee deems it appropriate to pay the judgment and interest in this lawsuit; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the proper City officers be and are hereby authorized and directed to issue a City check in the amount of $118,741.00, payable to the order of Mews Companies, Inc. and its attorneys, Niebler, Pyzyk, Klaver & Wagner, LLP, in full and final settlement of this lawsuit, upon receipt of a satisfaction of judgment approved as to form and execution by the City Attorney, $36,646.70 of said amount to be charged to Account No. 5T30383011, and the remainder to be charged to the Damages and Claims Fund, Account No. 0001-1490-636506-2631-S118-2001.
